The Terms and Conditions

I. General Provisions

  • 1.1 The operator of the Internet shop www.craftholic.cz is Korex s.r.o., Prague 10, Vršovická 1525/1c, Postal Code 101 00, Business ID Number: 27900576, Tax ID Number: CZ27900576
  • 1.2 The buyer is a natural person or legal entity that makes an order of goods through the Internet store craftholic.cz (hereinafter referred to as the Buyer).
  • 1.3 Relations and mutual rights and obligations of the Seller and a Buyer, who while ordering does not act in the framework of their business or other entrepreneurial activities, shall be governed by these Terms and Conditions, which are binding for both parties (hereinafter referred to as the Terms and Conditions), and the relevant legislation, in particular Act No. 40/1964 Coll., of the Civil Code, as amended, and by Act No. 634/1992 Coll., on Consumer Protection, as amended.
  • 1.4 If the conclusion of a contract through the Internet store https://www.craftholic.cz/ occurs between the Seller and the Buyer - other legal entity or physical person that in this context is acting within their commercial or other business activities (hereinafter referred to as the Buyer - entrepreneur), their mutual relations shall be governed by Act No. 513/1991 Coll., of the Commercial Code, as amended, and reasonably also by these Terms and Conditions. In this case, however, the Buyer shall not be considered to be a consumer, and therefore also does not have the right to withdraw from the contract without giving any reason in accordance with article IX. Paragraph 9.1 of these Terms and Conditions.
  • 1.5 By sending or making a binding order, the Buyer confirms that these Terms and Conditions are part of the purchase contract concluded between them and the Seller, and that they are properly acquainted with them, that they are clear to them, intelligible, and that they undertake to follow them. At this moment the Buyer also confirms that they accept the price of the ordered goods, including any dispatch and transport costs and all the Terms and Conditions in the version in force at the mom;ent of the making or sending of the order.
  • 1.6 These Terms and Conditions are valid from December 1, 2013. Any amendments and adjustments to the Terms and Conditions made after the order is sent are considered ineffective for the relevant relationship of the Seller and the Buyer. Amendments to regulations are reserved.

II. Subject of the Contract

  • 2.1 In concluding the purchase contract in accordance with these Terms and Conditions, a commitment arises for the Seller to deliver the ordered goods to the Buyer, and for the Buyer a commitment to take over these goods and pay the purchase price for them.
  • 2.2 The subject of the order by the Buyer may only be the goods listed on the craftholic.cz Internet store website.
  • 2.3 The Seller continuously updates the craftholic.cz Internet shop website in order to make the goods listed there reflect its actual offering. However, if the subject of the order of the Buyer of the goods is already not part of the Seller’s assortment at the time of the order, the Seller is obliged to notify the Buyer of this fact, with an offer of a solution to the situation (the termination of the contract or its modification).
  • 2.4 The subject of the purchase contract concluded between the Seller and the Buyer is only the supply of goods referred to in the confirmation of the order delivered properly and in a timely manner to the Buyer.
  • 2.5 The subject of the Seller’s obligation issuing from the purchase contract is not the demonstration, installation, assembly or installation of the goods being supplied.
  • 2.6 The characteristics of the goods listed on the website of the craftholic.cz Internet store, their description, parameters, dimensions, weight, and other particulars and information contained there are based on data from the manufacturers and suppliers of goods. All information is provided according to the current data available from manufacturers, suppliers, or other contracting entities and continuously checked. Nevertheless, its inaccuracy cannot be entirely ruled out, and for such a case the Seller reserves the right to changes. The Seller has the obligation to remove the inaccuracy of the information provided as soon as they become aware of them.

III. Buyer Registration

  • 3.1 The Buyer has the possibility to create their own customer account on the craftholic.cz Internet store website, doing so through their registration.
  • 3.2 Buyer registration is done directly through the craftholic.cz website. In the context of registration, the Buyer fills in the necessary personal data, which will be safely stored in the electronic database of the craftholic.cz Internet store, and which on subsequent log on and the placement of orders under their customer name and password do not need to be filled out by the Buyer.
  • 3.3 Registration and creation of their own customer account enables the Buyer to use a simplified procedure in the placement of orders (i.e. without reentering personal data).
  • 3.4. The Buyer is entitled to cancel their registration at any time, again through the craftholic.cz Internet store website or by phone. Cancellation of registration will be confirmed to the Buyer via electronic mail or telephone.

IV. Ordering of Goods, Order Cancellation

  • 4.1 A regular order of the goods made by the Buyer shall be considered a proposal for the conclusion of the contract, which is in effect towards the Seller from the moment this proposal is delivered to them.
  • 4.2 The order must contain, in particular, the exact designation of the Buyer, the address of the residence or seat, the shipping address, email and telephone connections, or other contact information about the Buyer, the exact designation of the kind and the number of units of the goods ordered, the shipping method and the method of payment of the price of the goods.
  • 4.3 The Buyer is entitled to make an order of goods in the following ways:
    • a. Through the craftholic.cz Internet store website, as an unregistered customer or after registration and login under their name and password as a registered customer
    • b. By phone at telephone number: 800 888 108 (Green line), + 420 730 891 289, on working days from 8:00 am to 5:00 pm or by email at: obchod@craftholic.cz or info@craftholic.cz
  • 4.4. The Buyer is entitled to cancel the order they made within 14 days after it is sent to the Seller, in the same manner that the order can be made.
  • 4.5 The purchase contract is deemed to have been concluded at the moment of confirmation of the order by the Seller and no sooner.
  • 4.6 The Seller shall confirm the Buyer’s order electronically to the email address indicated in the order.
  • 4.7 Confirmation of the order by the Seller shall include in particular the following information: identification of the Buyer, the kind of goods, number of pieces, the price for the goods, the method of delivery, the price for the delivery of the goods by the carrier and the delivery address.
  • 4.8 The seller undertakes to confirm the order to the Buyer without undue delay following its receipt. The order shall be deemed to be confirmed at the moment of delivery of the manifestation of will to confirm the order to the Buyer.
  • 4.9 If there is a cancellation of the order by the Buyer (also applies to the withdrawal from the purchase contract concluded by means of distance communication) or if the extinction of the order occurs for another reason at a time when the Buyer has already paid the purchase price of the goods or has taken the necessary actions to do so, the Seller undertakes to send the appropriate amount back to the Buyer’s account or by postal order (according to the agreement of the parties) to the Buyer within 30 (thirty) days from the withdrawal from the order. To maintain this period for repayment of the funds already provided, it will be sufficient if the Seller performs the necessary actions (e.g., make the payment order or give notice to the Buyer to pick them up) towards their return within this period. Withdrawal from the contract for natural persons shall be governed by the Civil Code (Section 53 paragraph 7) for legal entities by the Commercial Code.

V. Place of Performance

  • 5.1 The place of performance of the Seller’s obligation is the store/warehouse of the Seller at the Seller's operating premises, where the Seller passes the goods to the carrier of the shipping company to transport to the Buyer, or where the in-person pick-up of the ordered goods by the Buyer takes place.
  • 5.2 The Seller's obligation to deliver the ordered goods to the Buyer is fulfilled at the moment of its delivery and acceptance by the Buyer.

VI Price and Payment

  • 6.1 The price of the goods ordered by the client shall be governed by the prices listed for the ordered goods on the craftholic.cz Internet store website at the time of the sending of the order by the Buyer. The price of goods on the website include VAT at the statutory rate, unless it is explicitly stated without VAT for specific goods.
  • 6.2 Shipping charges will be added by the Seller to the price of the goods, which vary according to the chosen mode of transport. The specific mode of delivery is chosen by the Buyer. An overview of carriers and the current price list is listed on the www.craftholic.cz website in the section “Transport and Payment”. The Buyer undertakes to pay this price to the Seller under the terms of Article VII. and VIII. of these Terms and Conditions.
  • 6.3 The purchase price for the goods supplied and the costs of any transport will be paid by the Buyer by the selected payment methods - the Buyer has several options of how to pay the purchase price for the goods. The goods can be paid for in full in cash at the place of delivery of the goods via a contracted mail service, or by transferring the amount of the purchase price to the seller's account under the appropriate variable symbol identifying the payment (after receipt of your order we will send you the appropriate variable symbol).
  • 6.4 The purchase price shall be deemed duly paid only upon its crediting in full for the particular part of the shipment to the Seller's account or by paying the full amount in cash in the Seller’s store or to the employee of the shipping company. As a rule, the Buyer can take over the goods only after complete payment of their purchase price, unless otherwise agreed in writing by the contracting parties.
  • 6.5 The invoice issued by the Seller to the Buyer on the basis of the purchase contract between the Seller and the Buyer serve at the same time as a tax document and delivery note (warranty), and is sent by electronic mail, along with the tracking number during the shipment of the package.
  • 6.6 If the prices listed for particular kinds of goods on the craftholic.cz Internet store website are marked as “On Sale”, then they are valid while supplies last or until the next update of the offerings.

VII. Delivery Period

  • 7.1 In the event that the Seller has the goods in stock (the item marked on the website as “IN STOCK”), the Seller undertakes to dispatch them and hand over to the carrier without undue delay after the conclusion of the purchase contract. If the Seller does not have the goods in stock, the seller undertakes to inform the customer of this fact. The delivery period is governed by the shipping terms of the carrier according to he shipping method selected by the Buyer (usually 1-5 work days for the Czech Republic). The Czech Post Office stores unclaimed shipments (commercial and c.o.d. packages) for 7 days, after that it dispatches them back to the sender.
  • 7.2 If the Buyer chooses personal pick-up as the method of delivery of the goods supplied, then the Seller, if they have the goods in stock, undertakes to prepare them for collection without undue delay. If the goods are not in stock, the Seller undertakes to submit a note to the buyer about the time of the collection.
  • 7.3. In the event that Seller does not have the ordered goods in stock or is unable for any other reason to pass them to the carrier or to prepare for them for personal pick-up within the time limits in accord with the preceding two paragraphs, the Seller shall notify the Buyer by email or by phone of this fact, and at the same time give them the expected date of dispatch or the possibility of personal pick-up by the Buyer of the goods supplied.

VIII. Risk of Damage and the Ownership Rights to the Goods

  • 8.1 The risk of damage to goods supplied by the Seller to the Buyer on the basis of their order passes to the Buyer at the moment of its effective takeover.
  • 8.2 The ownership rights to the goods supplied by the Seller to the Buyer on the basis of their order shall pass to the Buyer at the moment of full payment of the purchase price of the goods to the Seller.

IX. Withdrawal from the Contract

  • 9.1 The Buyer is entitled to withdraw from the purchase contract concluded via the craftholic.cz Internet store without giving a reason, but not later than within 14 (fourteen) days from the date of the effective takeover of the goods supplied. Withdrawal from the contract is the right of the Buyer, which is regulated by Section 53, paragraph 7 of the Civil Code. However, this right must not be abused and used, for example, with the intend of borrowing the goods free of charge or temporarily use the goods.
  • 9.2 Among other legal reasons, the buyer does not have the right to withdraw from the purchase contract according to the previous paragraph especially in the case that the subject of the purchase contract was the delivery of goods the price of which depends on the fluctuations of the financial markets independent of the Seller’s will, and in the case of goods which are subject to rapid deterioration, wear and tear or obsolescence, as well as in the event that the subject of the purchase contract was the delivery of audio and video recordings and computer programs on which the buyer violated their original packaging, or in the case of the supply of newspapers, periodicals and magazines. The Buyer also does not have the right to withdraw in the event that the goods have been adjusted according to their wishes or for their person.
  • 9.3 In case of withdrawal from the contract pursuant to paragraph 1 of this article of the Terms and Conditions, the Buyer shall return the goods already delivered back to the Seller, preferably within 14 days from the date of the effective takeover of the goods supplied.
  • 9.4 The Buyer shall carry out the withdrawal from the contract preferably in writing to the address of the operating premises of the Seller.
  • 9.5 In case of withdrawal from the contract pursuant to the preceding paragraphs of this article of the Terms and Conditions, the Seller has the right to compensation from the Buyer for the costs incurred for purposes related to the canceled purchase contract (in particular the cost of the reintroduction of the goods for sale) and the Buyer agrees that the Seller shall offset the costs incurred for these purposes with a portion of the returned purchase price to the Buyer.
  • 9.6 The Buyer also has the right to withdraw from the contract without undue delay following the handover or delivery of goods other than those they ordered. In the event that the item at its the takeover by the Buyer is not in accordance with the purchase contract (hereinafter referred to as "Conflict with the Purchase Agreement"), the Buyer has the right to have the Seller bring the state of the item in correspondence with the purchase contract, free of charge and without undue delay, according to the request of the Buyer either by exchange of the item or its repair; if such a procedure is not possible, the Buyer may request a reasonable discount from the price of the item or withdraw from the contract. This does not apply if the Buyer knew about the Conflict with the Purchase Contract before taking over the item or if they caused the Conflict with the Purchase contract themselves.

X. Claims, Liability for Defects, Warranty Conditions

  • 10.1 The Buyer is advised to inspect goods without undue delay after their takeover. If the item has a defect at the time of its handover, the Buyer is entitled to reject its takeover. The Buyer is entitled to claim defects in handed over goods that were present at the time of their handover without undue delay.
  • 10.2 The Seller provides a warranty to the Buyer on the goods supplied through the craftholic.cz Internet store, for a period of 24 (twenty-four) months starting with the effective takeover of the goods by the Buyer. The warranty period can be set for an even longer length of time, if it is so indicated in the description of the goods on the craftholic.cz Internet store website, and if so provided by the supplier or manufacturer of this item. If defects arise in the supplied goods during the warranty period, the Buyer is entitled to claim these defects.
  • 10.3 Claims of defects of the goods shall be made by Buyer preferably in writing to the address of the operating premises of the Seller.
  • 10.4 Claims shall be considered unjustified in the event that the defect occurred through the use of the goods otherwise than stated in the instructions to them, normal wear and tear or damage, mishandling, improper storage, unprofessional tampering by the Buyer or a third person or as a result of natural disasters.
  • 10.5 In the event of a justified claim, the customer has the right to compensation of postage in the amount necessary for the handling of the claim (in case of handling of claims abroad, the company does not compensate the postage costs). In the case of an unjustified claim, the consumer is not entitled to reimbursement of their costs associated with the handling of the claim.
  • 10.6 If not specified or agreed otherwise, the rights and obligations of the Buyer and the Seller from liability for defects of the goods are governed by the relevant provisions of Act No. 40/1964 Coll., the Civil Code, as amended, and Act No. 634/1992 Coll., on Consumer Protection, as amended. In the case of a Buyer entrepreneur, the mutual rights from the liability for defects are governed by Act No. 513/1991 Coll., the Commercial Code, as amended, unless otherwise agreed.

XI. Protection of Personal Data

  • 11.1 The Seller undertakes to protect the personal data of the Buyer.
  • 11.2 This data will not be disclosed by the Seller to any third party, with the exception of those cases where the provision of information (e.g. address and telephone) is necessary for successful delivery of the goods to the Buyer.
  • 11.3 The Seller collects in particular the following information necessary for the successful conclusion of the purchase contract and the delivery of goods: name and surname, address of the Buyer, delivery address, telephone number and e-mail address.
  • 11.4 The Buyer has the right to request at any time, in writing, that the Seller erase the Buyer’s personal information in an appropriate way from its records, or carry out a required a change in the structure of the personal data of the Buyer.

XII. Copyrights, Trademarks, Rights of Third Parties, Liability

  • 12.1 The Seller is not liable to the Buyer or a third party for any damages, lost profits, costs incurred, interruption of activity or other damages arising in connection with the use of information given on the craftholic.cz Internet store website. Information about goods listed on the craftholic.cz Internet store website cannot be regarded as a declaration on the suitability of the goods for any particular purpose.
  • 12.2 All materials published on the craftholic.cz Internet store website are protected by copyright law. This website and its individual parts (in particular the descriptions and illustrations of the goods being sold, the category divisions of goods) may not be copied electronically or mechanically and made available to the public or otherwise used without the prior written consent of the Seller as the copyright holder.
  • 12.3 The Seller declares that it is the owner of the website craftholic.cz.
  • 12.4 The Buyer is obliged to avoid any interference with the rights of the Seller arising from the ownership of the above trade marks. The Buyer acknowledges that the names and designations of products, services and companies mentioned on the website of the craftholic.cz Internet store website may be registered trademarks of the respective third parties (suppliers, manufacturers of goods) and enjoy appropriate legal protection.
